6. What is agency by ratification? What are requisites of a

7. Define condition and warranty in a contract of sale of
goods. Under what circumstances a breach of condition is to be treated as
breach of warranty? 4, 6
8. Distinguish between dissolution of firm and dissolution
of partnership. Discuss the grounds on which a partnership firm may be
dissolved by the court. 4, 6
9. Answer the following problems. Give reasons in support
of your answer: 5, 5
(a) 'A', a minor
borrowed 10,000 from 'B' on a fraudulent misrepresentation that he was a major
and spent the amount. Can B sue him for the return of the amount?
(b) 'A' has two
houses, one is in Old Delhi and the other is in New Delhi. 'A' offers to sell
his Old Delhi house for 10,00,000. 'B' accepts the offer thinking it to be New
Delhi house. Is this agreement enforceable?
